TidyFolk Commercial Cleaning

These Terms and Conditions apply to all cleaning services provided by Tidy Folk Pty Ltd (ABN 69 690 230 614) trading as TidyFolk Commercial Cleaning (“TidyFolk”, “we”, “us”, “our”).

By accepting a quote, scheduling services, or allowing us access to your premises, you agree to these Terms and Conditions.

These Terms apply throughout Queensland, Australia and are governed by Queensland law.


1. Services & Scope of Work

1.1 All services are provided in accordance with a written cleaning scope issued with your quote.

1.2 Only tasks specifically listed in the agreed scope are included.

1.3 Any work requested outside the agreed scope must be approved by the nominated client contact and will be billed at our current hourly rate.

1.4 We reserve the right to decline tasks that are unsafe, unreasonable, or outside our professional cleaning remit.

1.5 If site conditions, usage, or requirements change, we may review and update the scope and pricing in consultation with you.


2. Scheduling & Access

2.1 Cleans are scheduled based on the agreed frequency and typically occur after hours or outside business trading hours, unless otherwise arranged.

2.2 You are responsible for providing safe, uninterrupted access to the site, including:

  • Keys or access cards
  • Lock-box details
  • Alarm codes
  • After-hours access procedures



2.3 Where keys or alarm codes are provided:

  • Keys are stored securely in a restricted-access safe
  • Alarm codes are stored securely in our Jobber CRM


2.4 If access is unavailable and we are not notified at least 24 hours before the scheduled visit, the clean will be considered completed and charged in full.

2.5 Missed cleans due to access issues do not automatically carry over to a later date unless agreed in writing.


3. Pricing, Invoicing & Payment

3.1 Invoices are issued after each cleaning visit, unless otherwise negotiated.

3.2 Payment terms are 14 days from invoice date.

3.3 Accepted payment methods:

  • Credit card (via Stripe through Jobber)
  • Bank transfer (details on invoice)


3.4 No late fees apply.

3.5 If an invoice becomes overdue:

  • Cleaning services may be paused until payment is received
  • Ongoing non-payment may result in termination of services


3.6 Pricing Adjustments: We reserve the right to apply an annual price increase of up to 5%, effective 1 July each year, to account for changes in CPI, operating costs, wages, and materials. This adjustment may be applied without prior notice and will take effect from the next billing cycle after 1 July.


4. Commitment Term & Plan Renewal

4.1 All cleaning plans operate on a monthly commitment basis.

4.2 Plans automatically renew on the first day of each month unless cancelled in accordance with these Terms.

4.3 To cancel or pause services, you must notify us at least two (2) business days before the end of the current month.

4.4 Cancellations received after this time will take effect from the following month.

4.5 No refunds are provided for partial months.


5. Care+ Services

5.1 Care+ services may be scheduled weekly, monthly, or quarterly, depending on the service and your plan.

5.2 All Care+ services included in your quote are included in the quoted price, with no separate charges.

5.3 Care+ services are performed only at their scheduled intervals (e.g. quarterly services occur once per quarter).

5.4 Unused Care+ services are not refundable or redeemable for cash.


6. Quote Validity & Changes

6.1 Quotes are valid for 30 days from issue date unless stated otherwise.

6.2 Prices exclude GST unless specified.

6.3 Pricing may be reviewed if:

  • Site size or layout changes
  • Frequency changes
  • Scope changes
  • Access requirements change


Any changes will be discussed and agreed with you before taking effect.


7. Health, Safety & Site Conditions

7.1 You are responsible for providing a safe working environment.

7.2 You must disclose any known hazards, including but not limited to:

  • Sharps
  • Biohazards
  • Asbestos
  • Unsafe surfaces or structures
  • Hazardous chemicals


7.3 We reserve the right to refuse or stop work immediately where conditions are unsafe.

7.4 We are not responsible for cleaning areas containing undisclosed hazards.


8. Damage, Loss & Liability

8.1 Any concerns regarding damage must be reported within two (2) business days of the relevant clean.

8.2 Our liability is limited to re-cleaning or repair of the affected area. Replacement costs are excluded.

8.3 We are not responsible for:

  • Pre-existing damage
  • Normal wear and tear
  • Poor-quality or fragile materials


8.4 We may take photos before and after the first clean to document pre-existing conditions.

8.5 Valuables should be secured prior to cleaning. We are not responsible for missing items unless irrefutable evidence proves fault by our staff.


9. Insurance

9.1 TidyFolk holds:

  • Public liability insurance
  • Workers compensation insurance

10. Call Recording

10.1 You acknowledge and agree that telephone calls with TidyFolk may be recorded for:

  • Training and quality assurance
  • Dispute resolution
  • Record keeping


10.2 Call recordings are stored securely and handled in accordance with our Privacy Policy and applicable Australian laws.


11. Confidentiality

11.1 All information relating to TidyFolk’s pricing, cleaning processes, systems, documentation, staff details, and operational methods is considered confidential information.

11.2 You agree not to disclose, copy, share, or make available any confidential information to third parties without our prior written consent, except where required by law.

11.3 This obligation survives termination of services.


12. Photography & Recording

12.1 You authorise TidyFolk staff to take photos or short videos of your site for quality assurance, training, record keeping, and marketing purposes.

12.2 Images will not intentionally include sensitive, confidential, or personal information.

12.3 You may request exclusion of specific areas by notifying us in writing.


13. Subcontractors

13.1 TidyFolk may use employees and/or subcontractors to deliver services.

13.2 All personnel are appropriately vetted, trained, insured.

13.3 We remain responsible for the standard of work performed.


14. Force Majeure

14.1 TidyFolk is not liable for failure or delay in performing services due to events beyond our reasonable control, including but not limited to natural disasters,
extreme weather, power outages, acts of government, pandemics, strikes or labour shortages, or equipment failure beyond reasonable control.

14.2 Where possible, services will be rescheduled. No liability arises from delays or cancellations caused by such events.


15. Termination

15.1 Either party may terminate services by notifying the other before the next billing month begins (see Section 4 for timing requirements).

15.2 We may terminate services immediately for non-payment, unsafe working conditions, abuse or harassment of staff, or illegal activity on site.


16. Non-Solicitation & Non-Circumvention

16.1 During the term of services and for a period of twelve (12) months after termination for any reason, you must not, without our prior written consent, directly or indirectly solicit, employ, engage, contract, or otherwise deal with any employee, contractor, or subcontractor of TidyFolk who has provided cleaning or related services at your site.

16.2 This includes engaging such persons through another business, third party, or alternative arrangement intended to replace, replicate, or circumvent TidyFolk’s services.

16.3 This restriction applies regardless of whether the individual approaches you independently.

16.4 You acknowledge that a breach of this clause would cause loss to TidyFolk, including recruitment costs, training, operational disruption, and loss of goodwill.


17. Limitation of Liability

17.1 To the maximum extent permitted by law, TidyFolk is not liable for indirect, incidental, or consequential loss.

17.2 Nothing in these Terms limits rights under Australian Consumer Law.


18. Changes to Terms & Conditions

18.1 We may update or amend these Terms and Conditions at any time, without prior notice.

18.2 The most current version will always be available on our website and will apply from the date of publication.

18.3 Continued use of our services constitutes acceptance of the updated Terms.


19. Precedence

19.1 These Terms and Conditions take precedence over any conflicting quote, email, or verbal agreement.

19.2 Where a quote includes additional terms, these Terms remain the governing document.

21. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.


22. Governing Law

These Terms are governed by the laws of Queensland, Australia, and both parties submit to the jurisdiction of Queensland courts.
